Federal solar incentives
As part of the Inflation Reduction Act of 2022, congress passed several clean energy provisions to reduce energy costs. Among those provisions was an extension and upgrade of the Federal Investment Tax Credit (ITC).
Federal Investment Tax Credit
The Federal ITC allows you to claim 30% of your total equipment and installation costs on your federal taxes. There is no minimum or maximum amount you can claim and it includes equipment, installation, permitting, and even battery storage.
The ITC will remain at 30% until December 31, 2032. After that it will be reduced to 26% until December 31, 2033, then to 22% the following year. The ITC is currently set to disappear in 2035 unless it is renewed.

Who’s eligible : Commercial
How to apply : Note: The Federal Infrastructure Investment and Jobs Act (IIJA) created the National Electric Vehicle Infrastructure (NEVI) Formula Grant Program with a total budget of $5 billion. Each state was allocated a share of that total to help build out a national network of electric vehicle charging stations along designated alternative fuel corridors (AFCs). With some limited exceptions, EV charging stations funded through the NEVI program should be spaced 50 miles apart and within one mile of the Interstate exit or highway. In the initial NEVI plan, the New York State Department of Transportation (NYSDOT), along with the New York State Energy and Research Development Authority (NYSERDA), noted that it is considering using NEVI funding to complement existing EV programs in the state (e.g. Make-Ready, EVolve, and the Volkswagen Settlement), to implement incentives for operations and maintenance, to provide capital for installations, or to further workforce development. New York has 21 alternative fuel corridors, three of which end at an international border crossing. In July 2023, the NYSDOT submitted the state's NEVI plan update. The update further aligns and articulates the state partner agency efforts and establishes primary and complementary goals and next steps, including how the state will achieve AFC build out efficiently and effectively, support medium- and heavy-duty EV charging, and light-duty EV charging beyond the AFCs. In October 2023, the state received its FY24 Approval Letter from the DOT. In this letter, the FHWA granted several exceptions for locations on I-84, I-87, I-86, and I-90. The FHWA also determined exceptions were not needed for locations on I-87/I-287, SR-27, and I-490.

How to apply : New York was the second state to adopt uniform interconnection standards for distributed generation (DG) systems. The New York Public Service Commission (PSC) originally adopted Standard Interconnection Requirements (SIR) for systems up to 300 kilowatts (kW) in capacity in December 1999. The Standard Interconnection Requirements (SIR) have subsequently been amended several times since, necessitated by changing net metering rules and other legislations. Most recently, the rules were updated on January 2017 which require the developers to demonstrate that they have obtained site control while applying for interconnection. During April to December in 2016 more than 2,000 projects between 50kW and 2MW filed for interconnection leading to interconnection application backlog. This rule is designed to help clear out this backlog of inactive proposals and allow more advanced projects to be completed. The SIR rules apply to systems up to five megawatts (MW) in capacity connected in parallel with the distribution system located in the service area of one of New York's six investor-owned local electric utilities: Central Hudson Gas and Electric, Consolidated Edison (Con Edison), New York State Electric & Gas, Niagara Mohawk (d/b/a National Grid), Orange and Rockland Utilities, and Rochester Gas and Electric. Generation facilities that are not designed to operate in parallel with the utility’s electrical systems are not subject to these requirements. The SIR addresses technical guidelines for interconnection and application procedures, with two separate sets of interconnection procedures and processes. Expedited Process: As amended in 2013, systems up to 50 kW are eligible for a simplified or expedited six-step process. Systems up to 300 kW may be eligible for this provided that the inverter based system is UL 1741 certified and tested. Systems proposed to be installed in underground network areas may be required to submit additional information and may subject to a longer review process. Systems of 50 kW or less are not charged an application fee. Basic Process: This process applies to all systems larger than 50 kW up to 5 MW, and systems between 50 kW and 300 kW that have not been certified and tested in accordance with UL 1741, applicants must use the basic 11-step process for interconnection as detailed in the SIR. Both processes cover the initial inquiry to final utility acceptance for interconnection and include interconnection timelines, responsibility for interconnection costs, and procedures for dispute resolution. The appendices contain a standard contract and standard application forms. Utilities are also required to maintain a web-based system for providing information on the status of interconnection requests to customers and contractors. The SIR contain minimum content requirements for this information system, and also require that utilities offer a web-based application process for systems of 25 kW or less. A current list of type-tested equipment is available on the PSC's DG website. Certified, inverter-based systems up to 25 kW are not required to have an external disconnect switch. The requirements specifically state that utilities are not permitted to require customers to purchase general liability insurance; however, the PSC does encourage distributed generation owners to purchase insurance for their own protection. Energy storage: The Standard Interconnection Requirement (SIR) was updated in October 2018 to include standards for interconnecting energy storage systems up to 5 MW AC. These standards apply to new hybrid projects, stand-alone projects, addition to energy storage system to an existing distributed generation facility, and changing of operating mode of existing hybrid or stand alone facility. Interconnection fee is calculated at $500 plus $4/kW capped at $3,000. The utility will have 20 days to perform the review and provide any modifications for control systems deemed necessary. The design of the system must include automatic disconnect device that will disconnect from the grid in case of power outage. Smart inverters: Starting January 1st 2023, utilities in NY will increasingly require all new solar and storage installations be configured to their preferred IEEE 1547-2018 set points. In addition, the New York State Standardized Interconnection Requirements document (NYS SIR) will be modified to require the use of UL 1741 SB listed inverters.

How to apply : Note: In 2010, the Federal Housing Finance Agency (FHFA), which has authority over mortgage underwriters Fannie Mae and Freddie Mac, directed these enterprises against purchasing mortgages of homes with a PACE lien due to its senior status above a mortgage. Most residential PACE activities subsided following this directive; however, some residential PACE programs are now operating with loan loss reserve funds, appropriate disclosures, or other protections meant to address FHFA's concerns. Commercial PACE programs were not directly affected by FHFA’s actions, as Fannie Mae and Freddie Mac do not underwrite commercial mortgages. Property-Assessed Clean Energy (PACE) financing effectively allows property owners to borrow money to pay for energy improvements. The amount borrowed is typically repaid via a special assessment on the property over a period of years, not to exceed the usefulness of the improvement. New York State General Municipal Law Article 5-L (PACE Statute) authorizes municipal corporations to create a sustainable energy loan program to provide financing to property owners for the installation of eligible Renewable Energy Systems or Energy Efficiency Improvements PACE financing is available through the Energy Improvement Corporation’s Energize NY OPEN C-PACE program (EIC). Not all municipalities have elected to join this program though all are able to. To download the current list (2.7.24) of participating municipalities , click here. Details: While this is largely intended for commercial use, eligible properties include one multifamily building or a portfolio of similar or related residential buildings on the same site, adjacent or associated sites. Owner-occupied one- and two-family homes, or townhomes are excluded. An Energy Audit is required in order to be eligible for the program. Loans can only be made for energy efficiency improvements determined to be appropriate through an energy audit. In the PACE Statute these are defined as “a formal evaluation of the energy consumption of a permanent building or structural improvement to real property…for the purpose of identifying appropriate energy efficiency improvements to be made to or incorporated into the construction of the property.” History of NY State PACE Legislation: In 2009 New York enacted two separate bills -- A.B. 8862 in August and S.B. 66004 in November -- authorizing local governments to offer these types of programs using different mechanisms. Although some similarities exist between the two authorizations, the latter is generally much broader in scope and allows for a more versatile set of local programs than the former. In order to qualify for a loan, energy audits or renewable energy feasibility studies must be performed by a contractor certified according to standards set by the New York State Energy Research and Development Authority (NYSERDA) or by a local government under standards at least as stringent as those developed by NYSERDA. Energy efficiency improvements must meet cost-effectiveness criteria also established by NYSERDA. The definition of eligible renewable energy systems includes solar photovoltaic, solar thermal, small wind, ground source heat pumps, anaerobic digester gas, fuel cell systems that generate electric or thermal energy, air source heat pumps, wood heating systems, and energy storage. NYSERDA is permitted to approve additional renewable energy technologies as eligible, with the exception of those that involve combustion or pyrolysis of solid waste. Loans may not be issued for energy efficiency improvements that have not been determined to be appropriate by an energy audit or for renewable energy systems that have not undergone a feasibility study. Municipal corporations are permitted to fund these programs using federal grant assistance or federal credit support mechanisms including direct loans, loan guarantees, and debt instruments. Municipal corporations may, but are not required, to provide for repayment of the loan through a charge on the real property which benefits from the loan. If a municipal corporation chooses this option, the charge must be collected at the same time and in the same manner as municipal taxes, but must be listed separately from other charges on the bill. In all cases, the loan constitutes a lien against the real property upon which the improvements take place. In August 2009, the New York legislature enacted A.B. 8862, allowing towns to create residential home energy efficiency programs funded by periodic charges or fees for the services rendered. The effect of this policy, although not precisely a loan, is similar to a loan. In towns that offer such a program, the town would be permitted to enter into contracts for home energy audits and energy efficiency improvements on behalf of participating residents. Participating residents benefit by having improvements made upon their property by the town at no up-front cost to themselves and are permitted to repay the town for the improvements through a periodic fee or charge. The charges associated with the service constitute a lien upon the property on which the improvements took place. In a characteristic unique to New York, the law integrates towns' ability to offer these programs into existing provisions under which towns create refuse and garbage improvement districts and collect fees for the provision of these services. The law specifically allows for programs that are designed for "the prevention or reduction of waste matter consisting of carbon components or energy waste from residential properties and the performance of energy audits and the purchase and installation of energy efficiency improvements on such residential properties." Solar thermal technologies are considered an eligible energy efficiency improvement for the purpose of such programs. The law itself appears to be modeled after the Long Island Green Homes Program which uses the same program structure. The Long Island Green Homes program was initiated in 2008 by the Town of Babylon.
Who’s eligible : Residential, Multifamily Residential, Low Income Residential
How to apply : The primary focus of EmPower+ New York program is to help low- and moderate-income households save energy and money towards energy improvements made to their property. The New York State Energy Research and Development Authority (NYSERDA) currently contracts with CLEAResult to implement the EmPower+ New York Program. Eligibility Applicants must meet income requirements to qualify for the program. In order to qualify, the customer must live in a 1-4 family home, and either participate in a utility payment assistance program; reside in a single family home located in a geographically eligible territory; or have an income below 80% of the State/Area Median Income. For both low and moderate-income 2-4 family homes, if 50% or more of the units are income-eligible for EmPower+, then the entire building is considered eligible. Both homeowners and renters are eligible to participate. Rental properties must have approval from the landlord/building owner for work to proceed. Landlords with income-eligible tenants are encouraged to talk to their residents to apply for the program. Program Description Through EmPower+ New York, homeowners and renters can receive a no cost comprehensive home energy assessment to pinpoint where energy and dollars are being wasted and receive a customized plan to lower energy usage, no-cost direct install improvements identified during the assessment can be installed by participating program contractors, and households can receive financial discounts on the cost of energy efficiency improvements. Prioritized core energy efficiency improvements include air sealing, insulation, replacement of inefficient refrigerators and freezers, and health and safety items. Homes that have had air sealing and insulation completed, contractors can make recommendations to upgrade other equipment including cold climate air source heat pump, heat pump hot water tank, and high efficiency gas heating upgrades. In order to participate, the applicant must submit an application available on the NYSERDA website or call 1-877-NYSMART. As part of the application process, applicants will select a participating contractor. After the application is approved, the chosen contractor will reach out to schedule an energy assessment. Within two weeks of the assessment, the contractor will present a report of findings to the household, identifying ways to save energy. Based on this report, the contractor will develop a work-scope to provide to the EmPower+ for approval. Once approved, the contractor will review the work-scope with the applicant, discuss out of pocket expenses (if any), and install the approved energy efficiency improvements. Low-income, single family households are eligible for no-cost energy efficiency improvements capped at $10,000 per project. While moderate-income, single-family households are eligible for a discount of up to 50% of the cost of eligible work capped at $5,000 per project. For low-income family rentals with 2-4 units, project funding caps are based upon $10,000 for the initial unit and $5,000 for each additional unit. Moderate-income family rentals with 2-4 units have project funding caps based upon $5,000 for the initial unit and $2,500 for each additional unit. EmPower vs. EmPower+ Previously, EmPower provided no-cost energy improvements for households earning 60% or less than the State Median Income. Assisted Home Performance with Energy Star provided a 50% cost-share towards energy efficiency measures for households earning between 60-80% of the Area/State Median Income. NYSERDA has combined these separate offerings into one program, EmPower+. In addition to the low income tier previously served by EmPower, EmPower+ also serves the moderate-income households who historically participated in Assisted Home Performance. Inflation Reduction Act Update In May 2024, New York became the first state in the nation to launch their Home Energy Rebate program, created by the Inflation Reduction Act (IRA). The first phase of the Home Electrification and Appliance Rebates (HEAR) program will be run through the state’s existing EmPower+ program.
Who’s eligible : Investor-Owned Utility
How to apply : Under the Climate Leadership and Community Protection Act (CLCPA) of 2019, New York has a mandate to deploy at least 9,000 MW of offshore wind capacity by 2035. Although offshore wind capacity is considered in the procurement targets set for other programs under New York's Clean Energy Standard, offshore wind capacity is procured separately. The New York State Energy Research and Development Authority (NYSERDA) conducts competitive solicitations in order to secure Offshore Wind Renewable Energy Certificates (ORECs). New York's offshore wind procurement strategy was laid out in the New York State Offshore Wind Master Plan, and competitive solicitations were conducted in 2018, 2020, 2022, and 2023. Contracts awarded through these solicitations have a minimum term of 20 years and a maximum term of 25 years. The 2018 solicitation resulted in contracts for ORECs representing 1,696 MW of capacity, and the 2020 solicitation resulted in contracts for ORECs representing 2,490 MW of capacity. The 2022 solicitation has provisionally awarded contracts for 4,032 MW of capacity, while the 2023 solicitation deadline was January 25, 2024. Regulatory actions on the Offshore Wind Standard take place in the New York Public Service Commission's Case No. 18-E-0071.
