Federal solar incentives
As part of the Inflation Reduction Act of 2022, congress passed several clean energy provisions to reduce energy costs. Among those provisions was an extension and upgrade of the Federal Investment Tax Credit (ITC).
Federal Investment Tax Credit
The Federal ITC allows you to claim 30% of your total equipment and installation costs on your federal taxes. There is no minimum or maximum amount you can claim and it includes equipment, installation, permitting, and even battery storage.
The ITC will remain at 30% until December 31, 2032. After that it will be reduced to 26% until December 31, 2033, then to 22% the following year. The ITC is currently set to disappear in 2035 unless it is renewed.
Who is eligible for the Federal ITC?
Most homeowners will qualify for the Federal ITC, but not all. You must meet the following criteria to claim your 30% tax credit:

Local solar incentives
Who’s eligible : Commercial, Industrial, Residential
How to apply : Note: Texas has an ongoing docket, Docket No. 54233, that is considering reforms to interconnection processes. The Texas Public Utility Regulatory Act (PURA) of 1999 included a provision that "a customer is entitled to have access… to on-site distributed generation," leading the Public Utility Commission of Texas (PUCT) to subsequently adopt interconnection standards. System Capacity Requirements Interconnection rules apply to electrical generating facilities (consisting of one or more on-site distributed-generation units) located at a customer's point of delivery, with a maximum capacity of 10 megawatts (MW) of capacity interconnected at any point in time at the point of common coupling and connected at a voltage less than 60 kilovolts. Independent School District Solar Generation (ISD-SG) has no generation capacity limit for interconnection. Equipment and operational requirements are differentiated based on connection type (single-phase or three-phase), paralleling mode and system size. An external disconnect device is required for all systems. Distributed Renewable Generation (DRG) is defined as generation equipment with a capacity of 2 MW or less provided by renewable energy technology. Owners of a DRG system outside of the Electric Reliability Council of Texas (ERCOT) area are permitted to interconnect through a single meter if they have a qualifying facility with a design capacity of 50 kilowatts (kW) or less and the DRG is rated to produce an amount of electricity that is less than or equal to the amount of electricity the owner consumed in the year before installation of the DRG. Process Standardized interconnection applications and interconnection agreements are used. Pre-certification provisions allow for fast-track interconnection for DRG with a capacity of 500 kW or less. No pre-interconnection study fees are required for units up to 500 kW (under most circumstances), and study fees for larger systems are limited. The time limit for pre-interconnection studies and application approval or rejection is 4-6 weeks. Owners of DRG and ISD-SG of 2 MW or less cannot be required to purchase additional liability insurance. Owners of DRG systems are required to provide proof that equipment carries a warranty against breakdown and undue degradation for a minimum of 5 years. Renewable Energy Certificates resulting from the operation of a DRG are property of the owner of the DRG. Neither a retail electric customer that uses DRG nor the owner of the distributed renewable generation that the retail electric customer uses is classified an electric utility, power generation company, or retail electric provider and is not required to register with or be certified by the PUCT if at the time DRG is installed, the estimated annual amount of electricity to be produced by the distributed renewable generation is less than or equal to the retail electric customer’s estimated annual electricity consumption. However, a person that owns electric generating facility rated at 1 MW or more and generates electricity that is not intended to be sold at wholesale must register with the PUCT as a self-generator, and a person that owns an electric generating facility rated at 1 MW or more, does not own transmission or distribution facilities, and generates electricity that is intended to be sold at wholesale must register as a power-generation company.

How to apply : In 2001 the Texas legislature enacted public building energy efficiency standards to help the state comply with federal Clean Air Act standards (see S.B. 5). The Texas Energy Partnership (TEP), consisting of State Energy Conservation Office (SECO), the U.S. Department of Energy's Rebuild America Program, and ENERGY STAR, was formed to help the counties and cities affected by S.B. 5 and subsequent legislation. The TEP holds workshops on energy-efficient building technologies, energy management, and other energy issues and has created a website for affected political subdivisions to report their energy savings data and to access information on benchmarking, best practices for energy efficient buildings, and green building techniques. There are numerous energy efficiency goals and requirements for various types of public and publicly-supported entities. The following descriptions highlight some of the most significant provisions (with the relevant statutory authorities in parentheses). Political Subdivisions, Institutions of Higher Education, and State Agencies Energy Conservation Goals (Health & Safety Code § 388.005 and Government Code § 447.009) Each political subdivision in the 41 urban and surrounding non-attainment counties, institution of higher education, or state agency is required to: implement all cost-effective energy efficiency measures to reduce electricity consumption in existing facilities; establish a goal to reduce the electric consumption by the entity by at least 5% each fiscal year for 10 years, beginning September 1, 2011. The goal was later changed to at least 5% each fiscal year for 7 years, beginning September 1, 2019; and report efforts and progress annually to SECO, including in the report justification that the entity has already implemented all available cost-effective measures if the entity fails to attain the established goals. State agencies are mandated to develop a plan for conserving energy that includes a percentage goal for reducing the agency’s use of electricity, gasoline, and natural gas. Each state agency must file a quarterly report with the governor and the Legislative Budget Board listing the goals identified in the agency’s energy conservation plan and a description of the progress made by the agency in meeting those goals. Purchasing Requirements (Government Code § 2165.009) A state agency or institution of higher education in charge and control of a state building is required to purchase for use in each type of light fixture in the building the commercially available model of light bulb that uses the fewest watts for the necessary luminous flux or light output that is compatible with the light fixture. Building Construction and Renovation Requirements (Government Code § 2166.401 et seq. and § 2311.001 et seq.) During the planning phase of proposed construction of a new state building, the agency or state institution of higher education undertaking the project must evaluate the economic feasibility of: using energy-efficient architectural or engineering design alternatives; or incorporating "alternative energy" systems to meet space heating or cooling, water heating, electrical loads, and interior lighting. Alternative energy is defined to include solar, biomass, wind, and geothermal energy sources. If economically feasible, the efficiency or alternative energy building design features must be included in the construction plans. When constructing or extensively renovating a "critical governmental facility" or replacing major heating, ventilation, and air-conditioning equipment for a critical governmental facility, the state governing body in charge of the facility must evaluate whether equipping the facility with a combined heating and power system would result in expected energy savings that would exceed the expected costs of purchasing, operating, and maintaining the system over a 20-year period. Critical government facilities are those that “serve a critical public health or public safety function” (e.g., police and fire stations, prisons, hospitals, data centers, water and wastewater facilities, etc.) that have a peak electricity demand exceeding 500 kilowatts. If the expected energy savings exceed the expected costs, the state governing body in charge of the facility may equip the facility with a combined heating and power system. School Districts (Education Code § 44.901 et seq.) The board of trustees of a school district are required to develop long-range energy plans to reduce the district’s energy use by 5% beginning in fiscal year 2008. The plan must detail strategies (e.g., facility design and construction improvements) for achieving energy efficiency that can be achieved without a net financial cost to the district over a 7-year period. The board may enter into energy savings performance contracts for the installation or implementation of energy and water conservation measures, such as building insulation; efficient lighting fixtures; heating, ventilation, or air-conditioning system modifications or replacements; and automatic energy control systems. Residential Buildings Receiving State Assistance (Government Code § 2306.187) New and rehabilitated single and multi-family dwellings that receive assistance from the state Department of Housing and Community Affairs (DHCA) also must meet specific energy efficiency standards. The DHCA is directed to establish minimum standards for such buildings that may include the use of ENERGY STAR appliances and products, energy-efficient alternative construction materials, air conditioning or heat pump equipment that exceeds the energy code, and air ducting systems inside the conditioned space. The standards will not apply to dwellings that receive weatherization assistance money from the department or money provided under the first-time home buyer program.

How to apply : Note: In 2010, the Federal Housing Finance Agency (FHFA), which has authority over mortgage underwriters Fannie Mae and Freddie Mac, directed these enterprises against purchasing mortgages of homes with a PACE lien due to its senior status above a mortgage. Most residential PACE activity subsided following this directive; however, some residential PACE programs are now operating with loan loss reserve funds, appropriate disclosures, or other protections meant to address FHFA's concerns. Commercial PACE programs were not directly affected by FHFA’s actions, as Fannie Mae and Freddie Mac do not underwrite commercial mortgages. Keeping PACE in Texas is currently assisting counties and municipalities with the creation, design, and implementation of locally-administered PACE programs. It provides a "PACE in a Box" toolkit for Texas counties and municipalities to create uniform, user-friendly, scalable, and sustainable PACE programs in Texas. Administration for Texas PACE programs is provided by The Texas PACE Authority, a nonprofit group founded in 2015. Property-Assessed Clean Energy (PACE) financing effectively allows property owners to borrow money to pay for energy improvements. The amount borrowed is typically repaid via a special assessment on the property over a period of years. Texas has authorized local governments to establish such programs, as described below. (Not all local governments in Texas offer PACE financing; contact your local government to find out if it has established a PACE financing program.) Texas first enacted legislation in May 2009 that authorizes municipalities to establish contractual assessments for energy efficiency and renewable energy improvements to commercial, residential, and industrial property. The law establishes the process for a municipality to establish a program, but many of the details of the program are determined locally. Texas passed subsequent legislation in 2013 (S.B. 385) that allows counties to also establish PACE programs, but only for commercial, industrial, and multifamily residential property. Under this new legislation a city or county may designate a single region or multiple regions within its boundaries as an assessment area. As required by the original law, the municipality must first pass a resolution stating its intent to designate an area for the assessment, even if the area will cover the entire municipality. That same resolution must include proposed details of the program and a public hearing must be held to receive feedback from constituents. The resulting municipal plan must determine and specify: eligible renewable energy systems and energy-efficient technologies; a method for ranking requests from property owners for financing through contractual assessments if requests exceed the authorization amount; whether the property owner may purchase the equipment directly or contract for the installation; the maximum aggregate dollar amount of contractual assessments; a map of the boundaries within which contractual assessments will be offered; a draft contract specifying the terms to be agreed upon by the municipality and a property owner; a method for ensuring that property owners who request financing have the ability to fulfill financial obligations; and a plan for raising the capital required to pay for work performed. The law allows municipalities to fund these directly or use proceeds from bonds. Furthermore, the plan must include information on how the interest rate and repayment schedule is determined and whether a reserve fund will be created. Once the municipal plan is implemented, property owners within the assessment area may opt-in to the program voluntarily. Subsequently, after they enter into a contractual assessment and receive funding for their energy improvements, a lien will be placed on their property and will remain until the assessment, and interest is fully repaid.

How to apply : The Light-Duty Motor Vehicle Purchase or Lease Incentive Program (LDPLIP) provides rebates across the state to people who purchase or lease new light-duty motor vehicles powered by a hydrogen fuel cell, compressed natural gas, liquefied petroleum gas (propane), or other electric drive (such as plug-in or plug-in hybrid), along with conversion systems for compressed natural gas or propane. How to apply : Property Owners' Associations (also known as Homeowners' Associations or HOAs) may not prohibit or restrict property owners from installing a solar energy device. There are, however, several exceptions that allow HOAs to enforce provisions that could prohibit the solar energy devices in certain situations. Associations may prohibit solar energy devices if they are found to be illegal or violate public health and safety, as decided by a court. HOAs may prohibit or regulate solar on common property within the subdivision or property that is owned or maintained by the association. HOAs may also regulate (or prohibit) solar devices that are on the roof if they extend above the roofline, are not parallel to the roofline, or do not conform to the slope of the roof. The HOAs may also regulate (or prohibit) solar energy devices installed on the ground in a fenced yard if they are taller than the fence. There are a few additional caveats that would allow HOAs to prohibit or restrict the installation of a solar energy device: if the solar energy device is installed in a way that voids its warranties or if any frames or wiring/piping are not silver, bronze, or black. The law also stipulates that the HOA may designate where the solar device should be located on a roof, unless a homeowner can show that the designation negatively impacts the performance of the solar energy device and an alternative location would increase production by more than 10%. Prior Approval The HOA may be allowed to prohibit the installation of a solar energy device if the homeowner does not receive prior approval from the association. If, in seeking the approval, the HOA finds that the proposed solar energy device will create a condition that harms or interferes with other people's "use and enjoyment of the land," the HOA may prohibit the installation as well. Homeowners should seek written support from neighboring properties in order to prove that this condition does not exist. Builder Restrictions In the case of developments or subdivisions that are still under the developers control and the HOA has not yet transferred to the property owners, the builder can prohibit or restrict a homeowner for installing a solar energy device only in developments with 50 units or fewer.
Can you claim multiple tax incentives in Texas?
